Sexual Harassment in the Workplace -Article March 2010

This is one of the worst things to look forward to when getting up in the morning. “Who is going to begin saying lewd things concerning me again today? Asking me on the subject of my sex life and how they might teach me a thing or two” or worrying “Is somebody going to endeavor to embrace me or grab at my bum” Sounds awful doesn’t it? But, the reality is, you certainly don’t have to suffer it. Harassment in the workplace is against the law. People sometimes believe it is hilarious to hassle the new boy or girl who has just started with the company, but to the individual troubled, it is misery.

There are a couple of aspects to this. There is the Sex discrimination Act which declares categorically that as an employer or employee you are forbidden to discriminate against anyone due to their gender. Then there is the meaning of harassment which means you are certainly not allowed to knowingly harass another being be it with lewd or degrading remarks or touching them inappropriately.

The agony that a human being has to deal with when confronted on a daily basis with this stressful situation, can be very destructive to their physical wellbeing and mental health. The situation for the employer is to have high turnover of personnel, higher than average sickness rates and poor production.

When you are suffering from harassment at work it is advisable to have a word with your line manager to discuss your concerns, they will then have a chat with the individual who is harassing you. If the person is mature, they will see they have been overstepping the mark and back off, you may even get an apology. Regrettably we are not all blessed with grown-up work colleagues, and a few will continue or even increase the harassment.

If this situation arises you are protected in Law, and if necessary you can follow the proper complaints or grievance process which means that your case will be officially dealt with either with ACAS or an Industrial Tribunal. You will be required to put together information relating to dates, times and regularity of the incidences as well as the details of the offences and witnesses if any.

No-one wants to be discriminated against or harassed at work and the more these situations are bought infront of the employers who are lawfully responsible, the less it will be tolerated.
